789 Soft provides a managed email marketing platform that enables users to create and deploy email campaigns to targeted audiences. Our Service includes:

• AI-powered email content generation using Google Gemini API
• Access to curated email subscriber lists
• Campaign management and analytics tools
• Country and category-based targeting

4. Invitation-Only Access

The Service is invitation-only. You may only create an account if you have received an invitation from an existing member or from our admin team. We reserve the right to refuse service to anyone for any reason.

5. User Accounts

• You must provide accurate and complete information when creating your account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

6. Credit System

• Our Service operates on a credit-based system
• Credits are purchased through our approved payment methods (USDC/USDT only)
• Minimum purchase amount is $500 USD equivalent
• Credits are non-refundable
• Credit costs vary by target country and category
• Unused credits do not expire unless account is terminated

7. Content Guidelines

Users must comply with the following content restrictions:

• Prohibited Content: Illegal products/services, adult content, gambling, pharmaceutical products without proper licensing, deceptive or fraudulent offers
• Manual Review: All websites and campaigns are subject to manual review and approval by our team
• Compliance: You must comply with all applicable laws including CAN-SPAM Act, GDPR, and local data protection regulations
• Rejection: We reserve the right to reject any campaign that does not meet our quality standards

8. Email Lists

• Our email lists are proprietary and have been built over 10+ years
• Lists are NOT for sale and cannot be exported
• All subscribers have opted in and are actively engaged
• We maintain strict send frequency limits to protect list quality
• Maximum 10 emails per month per subscriber

9. Performance and Deliverability

• While we maintain a 90%+ delivery rate, we do not guarantee specific results
• Open rates, click-through rates, and conversions depend on your content and offer
• We are not responsible for poor performance due to low-quality offers or websites

10. Payment Terms

• Accepted Payment Methods: USDC and USDT only
• Minimum Payment: $500 USD equivalent
• No Refunds: All credit purchases are final and non-refundable
• Pricing: Subject to change with notice

11. Intellectual Property

The Service, including all content, features, and functionality, is owned by 789 Soft Limited and is protected by international copyright, trademark, and other intellectual property laws.

12. Confidentiality

We do not share client data, campaign details, or case studies with third parties. Your privacy and confidentiality are our top priorities.

13. Limitation of Liability

To the maximum extent permitted by law, 789 Soft Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

14. Termination

We reserve the right to suspend or terminate your account at any time for:

• Fraudulent or illegal activity
• Spamming or abuse of the Service
• Non-payment
• Any other reason at our sole discretion

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of the Service constitutes acceptance of modified Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong SAR, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or use of the Service shall be resolved through arbitration in Hong Kong under the rules of the Hong Kong International Arbitration Centre (HKIAC).
